A BOA-FÉ E A TEORIA DA IMPREVISÃO NAS RELAÇÕES JURÍDICAS PÓS COVID-19

Resumo

O presente artigo busca esclarecer o cenário do direito privado frente a crise imposta pela Pandemia do Coronavírus (COVID-19) no direito privado brasileiro, através da Teoria da Imprevisão, disposto no art.317,421-A e 478, do Código Civil de 2002, com a relação dos temas da força obrigatória dos contratos junto a teoria da boa-fé contratual, decorrente do art.422, do mesmo diploma legal. Através de análise do que vem expondo a doutrina, prospectar os cenários que poderão ocorrer dentro do direito brasileiro, evitando a quebra contratual e um possível colapso dentro das relações privadas.

Abstract

This article seeks to clarify the scenario of private law against of the crisis imposed by the Coronavirus Pandemic (COVID-19) in Brazilian private law, through the Theory of Unpredictability, set out in art.317,421-A and 478, of the Civil Code of 2002, with the list of the subjects of the mandatory force of contracts together with the theory of contractual good faith, resulting from art.422, of the same legal diploma. Through an analysis of what has been exposing the doctrine, prospect the scenarios that may occur under Brazilian law, avoiding breach of contract and a possible collapse within private relations.
