Uma breve análise sobre os casos paradigmas de Justiça de Transição na Corte Interamericana de Direitos Humanos

Resumo

O presente artigo analisa os casos “Barrios Alto X Peru” e “Almonacid Arellano e outros X Chile” julgados pela Corte Interamericana de Direitos Humanos. Com o escopo de alcançar os resultados desejados, será utilizada a ferramenta metodológica qualitativa. Conforme se constatará, os dois casos tiveram dinâmicas distintas na Corte, visto que, no caso peruano, foi alcançada solução amistosa; já no caso chileno, registrou-se decisão judicial contrária aos interesses do país, em decorrência da defesa da manutenção de leis de auto-anistia, o que contraria a dinâmica da Convenção Interamericana de Direitos Humanos. Ambos os casos ainda norteiam o entendimento desta Corte sobre as violações de Direitos Humanos ocorridas durante regimes ditatoriais no continente americano.

Abstract

The paper analyzes the cases "Barrios Alto X Peru" and "Almonacid Arellano and others X Chile", judged by the Inter-American Court of Human Rights. In order to achieve the desired results, the qualitative methodological tool will be used. The two cases had different dynamics in the Court, once, in the Peruvian case, a friendly settlement was reached; However, in the Chilean case, the Court rendered a judicial decision contrary to the interests of the country, due to the defense of the maintenance of self-amnesty laws, which is contrary to the dynamics of the Inter-American Convention on Human Rights. Moreover, both cases guide the Court's understanding of the human rights violations that occurred during dictatorial regimes in the Americas.
