A TRAJETÓRIA DO DIREITO DO TRABALHO: A CONTEMPORANEIDADE DO TELETRABALHO E SUAS PECULIARIDADES NO ORDENAMENTO JURÍDICO BRASILEIRO

O presente artigo visa contribuir para discussão e ampliação do teletrabalho por ser uma temática de tamanha relevância, o qual requer a socialização das informações obtidas no processo de construção do saber. Ademais, é uma modalidade laboral que traz especificidades inerentes ao seu processo de implementação, desenvolvimento e evolução. Isto demonstra que a referida temática traz em seu cerne o viés histórico, social, econômico, político, cultural, tecnológico e jurídico, os quais foram se delineando a cada conjuntura, implicando na evolução dos institutos jurídicos e consequentemente dos bens jurídicos tutelados, sendo este fundamental para regulamentação dos direitos trabalhistas, especialmente do teletrabalho. É nesse cenário de diversidade que a referida temática vai se reconfigurando na sociedade contemporânea, seja pelos fatos reiterados demandados pela sociedade multifacetada, pelo quadro epidêmico ou pós-coronavírus que vai, sendo desvelada pela pesquisa desenvolvida e analisada, pela produção doutrinária e pela elaboração e promulgação das leis que balizam todo o processo de cognição.

This article aims to contribute to the discussion and expansion of telework, as it is a topic of such relevance, which requires the socialization of information obtained in the process of building knowledge. Furthermore, it is a work modality that brings inherent specificities to its implementation, development and evolution process. This demonstrates that the aforementioned theme brings at its core the historical, social, economic, political, cultural, technological and legal bias, which were delineating at each juncture, implying in the evolution of legal institutes and consequently of the protected legal assets, this being fundamental for the regulation of labor rights, especially telework. It is in this scenario of diversity that the aforementioned theme is being reconfigured in contemporary society, either by the reiterated facts demanded by the multifaceted society, by the epidemic or post coronavirus scenario that is going, being unveiled by the research developed and analyzed, by the doctrinal production and by the elaboration and enactment of laws that guide the entire process of cognition.
