Resumo
O referido estudo visa tratar acerca da problemática existente em relação à audiência
telepresencial cível, se a sua utilização é uma ferramenta de acesso à justiça ou se viola o
princípio da identidade física do juiz. Com foco especial nas ondas de acesso à justiça de
Cappelletti e Garth, ao qual analisam as necessidades de oferecer um sistema igualmente
acessível para todos e que produza efeitos individuais e socialmente justos. O artigo objetiva-
se em analisar, se a prática dessa espécie de audiência é eficiente e se realmente reduz as
demandas no Poder Judiciário, para tal inicialmente há uma verificação acerca das
modificações das audiências virtuais no processo civil no lapso temporal. Em seguida serão
analisadas se os direitos constitucionais de acesso à justiça e as normas processuais de
produção de provas estão sendo respeitados, tanto nas audiências no tribunal, como no
ambiente virtual, conciliando e escutando os interessados na solução de conflitos.
Abstract
This study aims to deal with the existing problem in relation to the civil telepresencial
hearing, whether its use is a tool for access to justice or violates the principle of the physical
identity of the judge. With a special focus on cappelletti and garth's access to justice waves,
which analyze the needs of offering an equally accessible system for all and that produces
individual and socially just effects. The article aims to analyze whether the practice of this
type of hearing is efficient and if it really reduces the demands in the Judiciary, for this
initially there is a verification about the modifications of virtual hearings in the civil process
in the temporal lapse. Next, it will be examined whether the constitutional rights of access to
justice and the procedural rules of evidence production are being respected, both in court
hearings and in the virtual environment, reconciling and listening to those interested in
resolving conflicts.
