O DIREITO PENAL NO ESTADO DEMOCRÁTICO DE DIREITO

Resumo

O objetivo deste estudo é analisar o princípio da culpabilidade como uma variante do postulado concernente à dignidade da pessoa humana. Procura-se demonstrar a importância de o juiz reafirmar os princípios inspiradores do garantismo, mesmo os que não se encontram expressos na Constituição Federal, mas que são decorrentes da garantia conferida à dignidade da pessoa humana, como o princípio da culpabilidade, compatível com o regime democrático adotado na atual Carta política brasileira. Por essas razões, em estudos preliminares realizados, constatou-se que o conceito de reprovação expresso em nossa legislação penal (artigo 59 do Código Penal) transformou a individualização da pena, nas decisões judiciais, em um processo de execração voltado para a conduta de vida do autor, ao invés de reprovar o fato por ele praticado. Dessa forma, pretende-se neste trabalho demonstrar que esse fato pode ser compreendido em uma perspectiva constitucional garantista, evitando a violação do Estado Democrático de Direito, em que o julgador deve considerar o princípio da dignidade humana como uma variante para amparar a culpabilidade na individualização da pena. No Brasil, as Políticas Públicas nem sempre alcançam o Poder Judiciário no exato momento em que se dá a relação entre o agente que praticou um crime e o Juiz quando da determinação da sua pena, conforme se varia no tempo histórico. Leis dispersas regulam genericamente situações protetivas, principalmente nos dias de hoje; nenhuma delas, seja por razões naturais ou sociais, é avaliada pelo Juiz em função do princípio da vulnerabilidade e, muito menos, tomando a vulnerabilidade como variável determinante da culpabilidade e pena consequente. Assim, realiza-se aqui um esforço de identificar essas situações na linha do tempo histórico, tanto nos períodos autoritários ou democráticos, como nas dimensões circunstanciais da atualidade.

Abstract

The purpose of this paper is to analyze the principle of blame as a variable of the postulate concerning the human dignity. It looks for demonstrating how important is the position taken by the judge in reaffirming the inspiring principles of warrantism, even those that are not expressed in the Federal Constitution, but are arising out of the warrant for the human dignity, as the principle of blame, compatible with the democratic regime adopted in the present Brazilian constitution. For those reasons, in some previous studies, it has been evident that the concept of reproach explicit in our penal legislation (article 59 of the Penal Code) transformed the individualization of punishment, in judicial decision, into a process of loathing directed to the conduct of life regarding the author, instead of reproving the fact practiced by him. So, in this paper there is an intention to demonstrate that such a fact can be understood in a warrantist constitutional perspective, avoiding the violation of the Democratic State of Law, where who judges must consider the principle of human dignity as a variable for supporting the blame in the individualization of punishment. In Brazil, Public Policies not always reach the judiciary in the exact moment in which is stablished the relationship between the agent who committed a crime and the judge when this determines his punishment, according to the changes that come up in historical time. Laws scattered in the legal system generically rule protective situations, mainly in current time; any of them is not evaluated by the judge for natural or social reasons – regarding the principle of vulnerability, but neither he takes the vulnerability as a causative variable of the blame and the consequent punishment. Therefore, an effort is accomplished here aiming to identify the situations above mentioned in the historical time frame, not only in authoritarian or democratic periods, but also in the cir-cumstantial dimensions of the present time.
