AS CONSTITUIÇÕES BRASILEIRAS DE 1824 E 1891 E A CONSOLIDAÇÃO DA RUPTURA DA ORDEM POLÍTICA

O constitucionalismo pode ser definido a partir de três diferentes perspectivas: formal, material e histórica. Sob a perspectiva formal, o constitucionalismo designa o ideal de dotar os Estados de constituições escritas. Em sua dimensão material, o constitucionalismo é o reflexo da incidência da ideologia liberal sobre o fenômeno constitucional. Por fim, o constitucionalismo pode ser ainda empregado para denotar o processo histórico que conduziu à homogeneização das formas e dos conteúdos das constituições do mundo ocidental contemporâneo. O artigo propõe-se a comparar as Constituições brasileiras de 1824 e 1891 demonstrando, numa narrativa histórica, que a primeira Constituição da República consolidou a ruptura da ordem política (monárquica/parlamentarista/unitária) e instauração de uma nova ordem (republicana/presidencialista/federativa). A metodologia científica adotada durante à execução da pesquisa pautou-se numa abordagem interdisciplinar (História do Direito e Direito Constitucional) haja vista a natureza do objeto.

Constitutionalism can be defined from three different perspectives: formal, material and historical. From a formal perspective, constitutionalism designates the ideal of endowing states with written constitutions. In its material dimension, constitutionalism is a reflection of the incidence of liberal ideology on the constitutional phenomenon. Finally, constitutionalism can still be used to denote the historical process that led to the homogenization of the forms and contents of the constitutions of the contemporary western world. The article proposes to compare the Brazilian Constitutions of 1824 and 1891 demonstrating, in a historical narrative, that the first Constitution of the Republic consolidated the rupture of the political order (monarchical/parliamentary/unitary) and the establishment of a new order (republican/ presidential/federative). The scientific methodology adopted during the execution of the research was based on an interdisciplinary approach (History of Law and Constitutional Law) in view of the nature of the object.
