COMUNICAÇÃO NÃO VIOLENTA EM PROCESSOS DE MEDIAÇÃO

Os métodos consensuais de resolução de conflitos destacam-se, como alternativa para o exercício da cidadania ante a precária prestação da tutela jurisdicional. Este artigo trata de uma reflexão sobre o uso da Comunicação Não Violenta (CNV) em processos de mediação no Poder Judiciário. O objetivo é auxiliar operadores do direito que atuam no âmbito da mediação judicial, no aperfeiçoamento da prática mediativa. Para que seja alcançado o objetivo proposto iniciamos com uma breve abordagem sobre a percepção sistêmica do conflito e, por fim, tratamos da CNV como uma ferramenta de mediação judicial.

NONVIOLENT COMMUNICATION IN MEDIATION PROCESSES

ABSTRACT: Consensus based methods of conflict resolution stand out as an alternative to the exercise of citizenship in the face of the precarious provision of judicial protection. This article deals with a reflection on the use of Nonviolent Communication (NVC) in mediation processes in the Judiciary. The objective is to assist legal operators who work in the field of judicial mediation, in the improvement of the mediation practice. In order to achieve the proposed objective, we begin with a brief approach on the systemic perception of the conflict and at last we treat the NVC as a judicial mediation tool.
