DO CONTRATO SEXUAL AO CONTRATO SOCIAL: UMA RELEITURA DA DICOTOMIA PÚBLICO-PRIVADO E A ABSTENÇÃO DA NEUTRALIDADE DE GÊNERO DA LEI MARIA DA PENHA SOB A PERSPECTIVA DO DIREITO INTERNACIONAL

Resumo

A dicotomia público-privado expõe o problema da polaridade destes conceitos, revelando um conflito entre deslegitimação e subordinação quanto ao sujeito passivo desta relação que são as mulheres. Logo, estão interseccionados. Nesse sentido, a presente pesquisa tem por objetivo analisar a história das mulheres frente a esta dicotomia, por meio do estudo da relação de poder estabelecida entre mente exploradora/corpo explorado e da sua relação com a abstenção da neutralidade de gênero da Lei Maria da Penha, sobretudo a sua importância a partir do prisma dos direitos internacionais, no intuito de responder ao seguinte problema de pesquisa: É necessária lei que se abstenha da neutralidade de gênero? Em caso afirmativo, qual a possível causa da naturalização da discriminação de gênero? E qual a sua relação com o direito internacional? Como método de abordagem, optou-se pelo dialético, utilizando como referencial teórico Carole Pateman, Jean-Jacques Rousseau, Aníbal Quijano, Flávia Pimentel e Sílvia Piovesan, bem como dados da Organização das Nações Unidas. Como procedimento utiliza-se o histórico em conjunto com o monográfico para investigar as instituições do passado e a influência na sociedade atual para melhor compreender a questão de gênero. Por fim, evidenciam-se possíveis causas, pois não há como definir que todas as mulheres vivem essa lógica, mas supõe-se que todas elas passaram por situações que consagram essa lógica.

Abstract

The public-private dichotomy exposes the problem of the polarity of these concepts, revealing a conflict between delegitimation and subordination as to the passive subject of this relation that are women. Then they are intersected. In this sense, the present research aims to analyze the history of women facing this dichotomy, through the study of the relationship of power established between exploiter mind / body explored and its relation to the abstention of gender neutrality of the Law Maria da Penha , especially its importance from the point of view of international rights, in order to respond to the following research problem: Is law necessary to refrain from gender neutrality? If so, what is the possible cause of the naturalization of gender discrimination? And what is its relation to international law? As a method of approach, the dialectic was chosen, using as theoretical reference Carole Pateman, Jean-Jacques Rousseau, Aníbal Quijano, Flávia Pimentel and Sílvia Piovesan, as well as data from the United Nations. As a procedure, the history is used together with the monograph to investigate the institutions of the past and the influence in the current society to better understand the gender issue. Finally, there are possible causes, because there is no way to define that all women live this logic, but supposes that all of them went through situations that consecrate this logic.
