LESÃO AO TEMPO: CONFIGURAÇÃO E REPARAÇÃO NAS RELAÇÕES DE CONSUMO

Na ciência jurídica, o tempo apresenta diversas perspectivas, ora repercutindo na aquisição, modificação e extinção de situações subjetivas, ora – fenômeno recente – objeto de tutela no campo da responsabilidade civil. Nesse cenário, proliferam hipóteses em que o fornecedor descumpre seus deveres contratuais e impõe ao consumidor despender seu tempo livre para resolver um problema causado pelo vício ou fato do produto adquirido ou do serviço prestado. Em outros casos, o tempo é “vendido” como objeto da relação negocial. Diante do estudo ainda incipiente do tema, de importância crescente na contemporaneidade, e de sua vinculação orgânica a valores existenciais tutelados preferencialmente pelo ordenamento, o presente trabalho dedica-se à análise dos paradigmas para a aferição da lesão ao tempo do consumidor e sua reparação no Direito brasileiro.

In legal science, time presents different perspectives, from repercussions on the acquisition, modification and extinction of subjective situations, to – a recent phenomenon – its judicial protection in the field of civil liability. In this scenario, there is a proliferation of cases in which the supplier disregards his contractual obligations and imposes on the consumer the need to spend his free time to solve a problem caused by product defect, consumer’s accident or the defect of the service rendered. In other cases, time is “sold” as the object of the business relationship. Despite the still incipient study of the matter, of the increasing importance in contemporary times, and its organic binding to existential values protected by the Law, this paper devotes itself to the analysis of the paradigms for the measurement of the injury to the time spent by the consumer and its remedy under the Brazilian law.
