O DIREITO FUNDAMENTAL À MORADIA: BREVES ANOTAÇÕES SOB A ÓTICA DE UM ESTADO DEMOCRÁTICO E A FUNÇÃO SOCIAL DA PROPRIEDADE

O presente artigo tem como objetivo apresentar uma breve análise sobre o direito à moradia, sob a ótica do direito constitucional, discorrendo sobre a importância do acesso à moradia na perspectiva de um Estado Democrático de Direito, quando, em um primeiro momento, apresenta-se o fundamento legal do Direito à Moradia no país, bem como demonstrando como os direitos fundamentais e humanos estão não somente interligados, mas também, condicionados aos direitos sociais; discutir, de forma breve, o conceito de direito à propriedade e a sua função social, por se tratar de elementos que norteiam o direito de propriedade e até mesmo o direito de habitação e de moradia; e examinar, brevemente, o caso emblemático no judiciário brasileiro, denominado como “O Caso da Favela Pullman”. Realiza-se, então, uma pesquisa qualitativa, de natureza básica, por intermédio de revisão bibliográfica e documental sobre o tema estudado, buscando estabelecer um paradigma teórico básico de fácil compreensão sobre a temática direito à moradia tanto no âmbito jurídico quanto no âmbito social.

This article aims to present the right to housing from the perspective of constitutional law, discussing the importance of access to housing in the perspective of a Democratic State of Law, when, at first, presenting the legal foundation of the Right to Housing in the country, as well as demonstrating how fundamental and human rights are not only interconnected, but also conditioned to social rights; briefly discuss the concept of the right to property and its social function, as these are elements that guide the right to property and even the right to housing and housing; and briefly examine the emblematic case in the Brazilian judiciary, known as “the pullman favela case”. A bibliographical review is then carried out on the subject studied, seeking to establish a basic theoretical paradigm that is easy to understand, democratizing the academy, addressing all possible aspects, both legal and social, about the right to housing.
