TERCEIRO SETOR E A PRESTAÇÃO FINALÍSTICA DE ASSISTÊNCIA JURÍDICA GRATUITA: UMA ANÁLISE DOUTRINÁRIA-NORMATIVA

O terceiro setor consiste em relevante bloco social intermediário entre o Estado e o comércio. Basicamente, a sociedade civil, diante da paulatina insatisfação com os serviços públicos e a imediata necessidade de defender direitos, passou a agir por conta própria, independentemente do aval estatal. Com isso, as entidades setoriais acumularam uma responsabilidade irrenunciável, uma vez que passaram a complementar as atividades de interesse civil. Dentre estas áreas desenvolvidas, pode-se citar a saúde, a educação, e o meio ambiente. Porém, esse rol está longe de ser taxativo e uma atividade específica que gera curiosidades é a prestação finalística de assistência jurídica gratuita, ou seja, determinada entidade setorial presta assistência à população juridicamente, com assessoramento e ingresso de ações. Isso não se confunde, porém, com o auxílio incidental prestado por estas entidades, em que, se as atividades desenvolvidas são educacionais, é permitida a tutela destes interesses judicialmente. Assim, espera-se abordar o tema de forma geral, dada a escassez de conteúdo acadêmico.

The third sector consists of a relevant intermediary social block between the State and commerce. Basically, civil society, faced with the gradual dissatisfaction with public services and the immediate need to defend rights, began to act on its own, regardless of state approval. As a result, the sectoral entities have accumulated an inalienable responsibility, since they started to complement activities of civil interest. Among these developed areas, one can cite health, education, and the environment. However, this list is far from being exhaustive and a specific activity that generates curiosity is the final provision of free legal assistance, that is, a specific sectoral entity provides legal assistance to the population, with advice and entry of actions. This is not to be confused, however, with the incidental assistance provided by these entities, in which, if the activities carried out are educational, judicial protection of these interests is allowed. Thus, it is expected to approach the topic in a general way, given the scarcity of academic content.
