A NOMEAÇÃO DE PARENTES PARA CARGOS POLÍTICOS E A SÚMULA VINCULANTE Nº 13

Resumo

O Nepotismo na administração pública é a prática de valorizar e priorizar laços de parentesco para o exercício da função pública em detrimento da avaliação de mérito. A discussão político-jurídica sobre o nepotismo é fomentada pela interpretação casuística do Supremo Tribunal Federal flexibilizando a literalidade restritiva do texto da Súmula Vinculante nº 13 no que tange às nomeações de parentes para ocuparem cargos de natureza política. Evidencia-se uma insegurança jurídica haja vista que a Súmula Vinculante nº 13 não atinge in totum seu objetivo. O artigo propõe-se analisar a dificuldade da pacificação e uniformização do tratamento do tema pelo Supremo Tribunal Federal. Problema que se impõe a investigar: A Súmula Vinculante nº 13 sofre uma mutação e faz-se mister uma revisão?

Abstract

Nepotism in public administration is the practice of valuing and prioritizing kinship ties for the exercise of public function to the detriment of the assessment of merit. The political-legal discussion about nepotism is fostered by the casuistic interpretation of the Supreme Federal Court, easing the restrictive literality of the text of the Binding Precedent nº 13 regarding the appointment of relatives to occupy positions of a political nature. A legal uncertainty is evidenced, since the Binding Precedent No. 13 does not attain its objective. The article proposes to analyze the difficulty of pacifying and standardizing the treatment of the topic by the Federal Supreme Court. Problem that needs to be investigated: Does the Binding Precedent nº 13 mutate and a revision is required?
