RESPONSABILIDADE PENAL DO PSICOPATA

O presente trabalho trata da responsabilidade penal do psicopata, com o embasamento teórico fundamentado nos conhecimentos da área do direito, mas também da área da psicologia e da psiquiatria. Para promover a melhor compreensão do tema, a estrutura do presente trabalho foi dividida em quatro seções. A primeira visa definir o que é psicopatia e a segunda visa identificar a psicopatia, com o auxílio de especialistas da área da psicologia e da psiquiatria. A terceira seção trata da responsabilidade penal do psicopata segundo a atual legislação, enquanto a quarta e última sustenta que a medida de segurança perpétua é a sanção penal mais adequada ao psicopata de grau grave.

This paper deals with the criminal liability of the psychopath, with a theoretical foundation based on the knowledge of the area of law, but also of psychology and psychiatry. To promote a better understanding of the theme, the structure of this paper was divided into four sections. The first aims to define what is psychopathy and the second aims to identify psychopathy, with the help of specialists in the field of psychology and psychiatry. The third section deals with the criminal responsibility of the psychopath under current legislation, while the fourth and last section argues that a life sentence is the most appropriate penal sanction for the severe psychopath.
